PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ENTERING INTO THIS COMPETITION, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS BELOW, DO NOT ACCESS THE COMPETITION PAGE, OR ANY RELATED PAGES THEREOF. ENTERING INTO THE COMPETITION IMPLIES THAT YOU HAVE READ, UNDERSTOOD AND ACCEPTED ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT AND YOU ARE BOUND BY ALL OF ITS PROVISIONS.
1. The promoter is: Tata Consultancy Services whose registered office is at Gustav Mahlerplein 85-91, 1082 MS Amsterdam, Netherlands.
2. The competition is open world-wide except business profiles or employees of TCS and its affiliates.
3. There is no entry fee and no purchase necessary to enter this competition.
4. Only one entry will be accepted per person. Multiple entries from the same person will be disqualified.
5. The competition will run each day on the 18 October 2022 to 25 October 2020. To post on your Instagram a video or photo of your training or running the TCS Amsterdam Marathon using the hashtag #ThisRunAmsterdam.
6. Closing time for entry will be 23.59 CET of 25 October 2020. After this time, no further entries to the competition will be permitted.
7. No responsibility can be accepted for entries not received for whatever reason.
8.TCS will judge the competition and decide on the winner each day, which will be picked from all complete entries via Instagram.
9. The winner will be notified by Direct Message (DM) on Instagram within 28 days of the closing date. If the winner cannot be contacted or does not claim the prize within 14 days of notification, TCS reserves the right to withdraw the prize from the winner and pick a replacement winner.
10. TCS will notify the winner via Instagram. TCS will ship the item worldwide as soon as practicable after the announcement of the results.
11. TCS’ decision as to those able to take part and selection of winners is final. No correspondence relating to the competition will be entered into.
12. The prize is Mizuno shoes and t-shirt. The prize is as stated and no cash or other alternatives will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.Winners will be chosen from all entries received and verified by Promoter and or its agents. Our decision is final.
13. TCS is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.
14. By submitting/posting any information or material (including videos and photos) for the competition, the entrant assures TCS that he/she has not violated any intellectual property right of any person or party in partial or full.
15. Any personal data relating to the winner or any other entrants will be used solely for the purposes of allowing participants to join the contest and for the winners to receive the prices, in accordance with applicable data protection legislation. All personal data will be deleted after the completion of the contest. 16. The entrant also undertake not to do the following in the course of the competition: i) Make postings or upload any content that is unlawful, libelous, abusive, obscene, discriminatory, hateful, threatening, pornographic in nature, prurient, likely to incite violence ii) Use unparliamentary or abusive language iii) Harass, bully, intimidate, abuse or harm another person, group, institution or entities that are part of the competition iv) Send unwelcomed, irresponsible or inciting communications to other competitors using features of competition v) Make postings or upload any content that tries to market or promote any product or service including self-promotion vi) Make or use the competition for any form of expression or discussion on politics and religion vii) upload content that contains viruses, worms, or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications.
17. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other Social Network. You are providing your information to Tata Consultancy Services Netherlands and not to any other party.
18. TCS shall have the right, at its sole discretion and at any time, to change or modify these terms and conditions, such change shall be effective immediately upon posting to this webpage.
19. TCS’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
20. TCS reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of any reason beyond its reasonable control, including but not limited to, by fire, flood, earthquake, elements of nature or acts of God, epidemic, acts of state, strikes, acts of war, terrorism, riots, civil disorders, rebellions or revolutions; quarantines, embargoes and other similar governmental action. Any changes to the competition will be notified to entrants as soon as possible by TCS.
21. The entrant should abide with all the terms and conditions listed; failure to comply or fulfill the outlined terms and conditions would attract immediate disqualification from the competition apart from other remedies available to TCS under these terms and conditions of under law.
22. The entrant agrees to fully indemnify and hold TCS harmless for all damages, losses, and costs arising out of breach of these terms and conditions by the entrant.
23. The competition and these terms and conditions will be governed by Netherlands law excluding its conflict of law principles. If any provision is held by a Court to be illegal, invalid or unenforceable, the remaining provisions shall remain in full force and effect Unresolved disputes, if any shall be subject to resolution by arbitration in the Netherlands. The language of the Arbitration shall be English. The venue of Arbitration shall be Amsterdam, Netherlands.
24. If the entrant is under the age of 18, we will need written consent from his/or her parent or guardian to share with TCS the personal details such as name, tshirt and foot sizes, and home delivery details.
